CALL for comments on the draft decision on the withdrawal of the designation of CETIN a.s. as an undertaking with significant market power on the basis of the results of the analysis of relevant market No. 3b - wholesale central access provided at a fixed location for mass- market products'
To implement Section 51(11) of Act Electronic Communications Act, CTU has prepared on the basis of the analysis of relevant market No. 3b - wholesale central access provided at a fixed location for mass- market products, a draft decision on the withdrawal of the designation of CETIN a.s. as an undertaking with significant market power on the above mentioned relevant market.
CTU issued the Relevant Market Analysis No. 3b as a Measure of General Nature No. A/3b/07.2023-3. This Measure was published in the Telecommunications Bulletin on 26 July 2023, Volume 3/2023. The analysis of relevant market No. 3b found that the relevant market in question is an effectively competitive market, as no undertaking with significant market power is active on it on the basis of the analysis carried out, i.e. the market in question no longer meets the three criteria test and the application of ex ante regulation on the analysed market No. 3b is not possible. It thus omitted the reason for designating CETIN a.s. as an undertaking with significant market power on the relevant market in question. For the above reasons, the designation of CETIN a.s. as an undertaking with significant market power in market No. 3b is withdrawn pursuant to Section 51(11) of the Act.
In compliance with Section 130(1)(b) of the Electronic Communications Act, the draft decision shall be submitted for the consultation with stakeholders.
Comments on the draft decisions shall be sent within 30 days after the day of the publication of this call. i.e. by 22 September 2023.
Following the public consultation the comments will be settled, and CTU will finalise the relevant administrative proceeding with CETIN a.s.
