Analyses of relevant markets
CTU designates relevant markets in electronic communications, including the criteria for their definition and the criteria for assessing significant market power, for which it then carries out analyses to assess whether they are effectively competitive. If the analysis identifies an undertaking with significant market power, CTU imposes obligations on that undertaking that are appropriate to the market situation. CTU published information on the launch of the analyses and the issue of the relevant measures of general nature (which contain the analyses) in the Analyses of relevant markets section, where subsequent decisions on the designation of undertakings with significant market power or on the imposition of obligations on such entities can also be found. The list of relevant markets susceptible for ex-ante regulation is then set out by CTU in Measure of General Nature No. 1 establishing relevant markets in the electronic communications, including criteria for assessing significant market power - the current measure is available in the Measures of general nature section (including network plans).
Yes, pursuant to Section 130 of Electronic Communications Act, CTU is obliged to consult, inter alia, draft measures of general nature, decisions on prices and decisions having a significant impact on the relevant market with stakeholders (meaning in particular undertakings in electronic communications or their associations) in the form of a public consultation. The purpose of the consultation is, in line with the principles of transparency and objectivity, to obtain comments, views and opinions of stakeholders on the draft measures to be adopted.
