CALL for comments on the draft decision on the designation of CETIN a.s. as an undertaking with significant market power on the basis of the result of the analysis of relevant market No. 1 - 'Wholesale local access provided at a fixed location'

On the basis of the analysis of relevant market No. 1 - 'Wholesale local access provided at a fixed location, issued by Measure of General Nature No. A/1/07.2023-2, as amended by the Measure of General Nature A/1/04.2025-4, and to implement Section 51(6) and (10) of the Electronic Communications Act, CTU has prepared a draft decision on the designation of CETIN a.s. as an undertaking with significant market power in 72 defined territorial units (administrative districts of municipalities with a designated municipal authority – POÚ) in the above mentioned relevant market,

The Measure of General Nature No. A/1/04.2025-4 was published on 9 April 2025 in the Telecommunication Bulletin, Volume 4/2025. The analysis of relevant market No. 1 has revealed that CETIN a.s. has significant market power in additional 39 POÚ beyond the existing 33 POÚ identified in Measure of General Nature No A/1/07.2023-2. Thus, in total, CETIN a.s. was found to have SMP in 72 POÚ in relevant market 1.

In accordance with the provisions of Section 130(1)(b) of the Electronic Communications Act, the draft decision is submitted for public consultation with stakeholders.

Pursuant to Section 130(6) of the Electronic Communications Act, comments on the draft decision may be submitted within 30 days of the date of publication of this call.

After the end of the public consultation, CTU will settle the received comments and complete  administrative proceedings with CETIN a.s.
