CALL for comments on draft decisions on the designation of CETIN a.s. as an undertaking with SMP on the basis of the results of the analysis of market No. 1 – Wholesale local access provided at a fixed location

To implement Section 51(6) of Act Electronic Communications Act, CTU has prepared on the basis of the analysis of relevant market No. 1 "wholesale local access provided at a fixed location, a draft decision on the designation of CETIN a. s as an undertaking with significant market power in 33 defined territorial units (administrative districts of municipalities with a designated municipal authority) on the above mentioned relevant market.

CTU issued the Relevant Market Analysis No. 1 as a Measure of General Nature No. A/1/07.2023-2. This Measure was published in the Telecommunications Bulletin on 26 July 2023, Volume 3/2023. The analysis of relevant market No. 1 found that the 33 territorial units (administrative districts of municipalities with a designated municipal authority) belonging to segment B of the defined market, representing separate geographical markets, are not effectively competitive markets, as CETIN was found to be the undertaking with significant market power operating on them. Thus, on the basis of the result of the analysis of relevant market No. 1, CTU hereby designates CETIN as the undertaking with significant market power in the 33 territorial units concerned by this Decision.

In compliance with Section 130(1)(b) of the Electronic Communications Act, the draft decision shall be submitted for the consultation with stakeholders.

Comments on the draft decisions shall be sent within 30 days after the day of the publication of this call. i.e. by 22 September 2023.

Following the public consultation the comments will be settled, and CTU will finalise the relevant administrative proceeding with CETIN a.s.
