CALL for comments on the draft Measure of General Nature No. A/1/XX.2024-Y amending Measure of General Nature – Market Analysis No. A/1/07.2023-2

Market No. 1 – Wholesale local access provided at a fixed location

In accordance with Section 51(10) of the Electronic Communications Act, CTU prepared draft Measure of General Nature No. A/1/XX.2024-Y, amending Measure of General Nature – Market Analysis No. A/1/07.2023-2, market No. 2 - Wholesale local access provided at a fixed location. CTU did so following the conclusions of the analysis of the impact of the concentration of CETIN a.s. and Nej.cz s.r.o. and the conclusions of the related public consultation. In the Measure, CTU also took into account the purchase of M.NET Studénka s.r.o. and the anticipated acquisition of the infrastructure of Nordic Telecom Regional s.r.o. by CETIN a.s. and thus supplemented the analysis by the newly classified POUs (administrative districts of municipalities with a designated municipal authority) in segment B, in which CETIN a.s. has significant market power on the relevant market.

The CTU's change in the Measure reflects a change in the market situation, where the acquisitions in question have strengthened the market position of CETIN a.s. in some areas of the Czech Republic where the acquired companies operated on their own infrastructure. The Measure proposes to extend the designation of CETIN a.s. as an undertaking with significant market power in this relevant market to 39 additional POUs. In total, therefore, CETIN a.s. has been found to have SMP in 72 POUs, as set out in Articles 1 and 2 of the consulted Measure. Thus, in the 39 POUs concerned, CETIN a.s. is proposed to be subject to obligations which are to the same extent as those imposed on it in 33 POUs by the Measure of General Nature No A/1/07.2023-2.

Pursuant to Section 130(1)(a) of the Electronic Communications Act, draft measure of general nature No A/1/XX.2024-Y is submitted for consultation with stakeholders.

Comments on the draft shall be submitted within 30 days from the date of publication of this call, i.e. by 29 November 2024.
