CALL for comments on the impact analysis of a concentration of CETIN a.s. and Nej.cz s.r.o.

CTU stated in its analysis of the relevant market No. A/1/07.2023-2, Market No. 1 – wholesale local access provided at a fixed location and No. A/3b/07.2023-3, Market No. 3b – wholesale central access provided at a fixed location for mass-market products that it would assess the impact of the concentration of CETIN a.s. and Nej.cz s.r.o. on the validity of the conclusions of the analyses of the relevant markets concerned once the decision of the Office for the Protection of Competition (ÚOHS) on this transaction has been reached. ÚOHS evaluated the effects of the concentration of CETIN a.s. and Nej.cz s.r.o. and issued a notification of concentration approval on 15 November 2023 and subsequently published the text of the decision including the related commitments of CETIN a.s. on its website on 21 December 2023. CTU was thus able, in accordance with its competences, to subsequently conduct a comprehensive analysis of the impact of the given transaction, including the adopted commitments, on competition in the field of electronic communications.

CTU is submitting this impact assessment for consultation with stakeholders. The consultation is carried out outside the regime of Section 130 of the Electronic Communications Act.

Comments on the impact analysis in question may be submitted within 30 days of the date of publication of this call, i.e. by 26 July 2024.

Following the public consultation, the comments will be addressed and the results of the public consultation will be taken into account in further procedural steps in the relevant market analyses.
