CALL for comments on intention of the Czech Telecommunication Office to grant block allocations of radio frequencies in the frequency band 800 MHz, 1800 MHz and 2600 MHz pursuant to Section 20(7) of the Electronic Communications Act
On the basis of a request from holders of radio frequency block allocations in the 800 MHz, 1 800 MHz and 2 600 MHz frequency bands, i.e. O2 Czech Republic a.s., with its registered office at Za Brumlovkou 266/2, Michle, 14022 Prague 4, IČO 60193336, T-Mobile Czech Republic a.s., with its registered office at Tomíčkova 2144/1, Chodov, 14800 Prague 4, IČO: 64949681 and Vodafone Czech Republic a.s., headquartered in Junková Square 2808/2, Stodůlky, 15500 Prague 5, ID No 25788001 (hereinafter referred to as ‘the block allocation holders’), submitted pursuant to Section 20(4) of Act No 127/2005 on electronic communications and amending certain related acts (the Electronic Communications Act), as amended (hereinafter referred to as ‘the Act’), the Czech Telecommunication Office (‘the Office’) carried out a review of whether there are still grounds for limiting the number of rights to use radio frequencies in the 800 MHz, 1 800 MHz and 2 600 MHz frequency bands (hereinafter referred to as ‘the review’) and whether that limitation needs to be maintained.
On the basis of the conclusions of the review (Czech only), the Office concluded that the current limitation of the number of rights of use of those radio frequencies needs to be maintained in order to allow not only the continued provision of current electronic communications services but also the development of new ones. As also stated in the conclusions of the review, in the light of the facts and information available at the time of the review, the Office envisages, in accordance with Section 20(7)(a) of the Act, the issuance of new block allocations to O2, T-Mobile and Vodafone in the 800 MHz, 1 800 MHz and 2 600 MHz bands for a period of validity of 20 years, determined in accordance with Section 22(5) of the Act, with effect from 1. 7. 2029.
A draft of the conditions relating to the efficient use of radio frequencies, which should be included in the new block allocations, is set out in the Annex to the review conclusions. The conditions shall include an obligation to improve the availability of the signal in so called white areas and along rail corridors and to increase the resilience of base stations against power failure.
Pursuant to Section 20(7) of the Act, the Office ensured the valuation of the block allocation of radio frequencies in the 800 MHz, 1 800 MHz and 2 600 MHz frequency bands by an expert institute. The expert determined the value of the block allocation in the aforementioned frequency bands in an expert opinion (Czech only), as stated in Chapter 6.2 of the opinion on page 76.
Following the consultation pursuant to Section 130 of the Act, which includes the results of the review and evaluation of the block allocation, the Office intends to invite the block allocation holders to apply for new block allocations. The Office shall decide on the application submitted in accordance with the applicable version of the Act without a selection procedure pursuant to Section 21 of the Act. The price of the block allocations will be determined in accordance with the valuation that has been conducted.
Comments on the intention may be submitted in accordance with Section 130(6) of the Act no later than 30 days from the date of publication of this call, i.e. 14. 9. 2026.
